The International Court of Justice (ICJ) has stated that Israel is obligated to meet the "basic needs" of the population in Gaza. The ruling, announced on Wed, Oct 25, 2023, requires Israel to support the relief efforts led by United Nations entities in the Gaza Strip.
The ICJ highlighted that Israel has not provided evidence to support its claims that the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA) has connections with Hamas. According to ICJ President Yuji Iwasawa, Israel’s allegations against UNRWA employees being members of Hamas or other terrorist factions were unsubstantiated.
Humanitarian Aid and Ceasefire Provisions
The advisory opinion from the ICJ, although non-binding, carries significant legal and political weight. Previous accusations were made against Israel for violating international law by restricting aid into Gaza. A 20-point ceasefire plan allows for 600 aid trucks per day into Gaza, although actual deliveries have fallen short of this target.
Abeer Etefa, spokesperson for the UN’s World Food Programme, reported that 530 trucks had delivered over 6,700 tonnes of food since the ceasefire, falling short of the 2,000 tonnes daily target. The ICJ affirmed Israel’s obligation as an occupying power to ensure basic supplies for the survival of the local population and not to impede these provisions.
